I HAVE BEEN WRONG!

I know that this is hard to believe, but just today I was talking with a past client and realized that so many past, present and future customers and clients don't really understand what my job involves! But more important than that, it's what I can do for them or you. It's taken me 30+ years to learn this even though I have the lapel pin that reads "Let Me Tell You How I Work! (Guess I should have not put that in a drawer!) When talking with Steve Savmidollars I learned his parents were going to move here to be closer to their darling granddaughter Sally Sunshine Savmidollars. I also learned they also had an appointment with Nellie Nubuild to build a brand new home. Oh I can help them, says I, and was told they had already set everything up. Dismayed I said, but did you know that they have no representation if something goes wrong? Did you know that it won't cost them one iota (Steve Savmidollars knows this money lingo) to have me there with them? Ah, but they have already done it, says he. Oh, I said wistfully, I wish I had known. I helped Henry and Harriet Homeowner get granite countertops that they didn't expect, plus get their home finished by the time they had their annual Homeowner Hoedown so it wouldn't have to be in a tent. But, woe is me, I was too late to help the Senior Savmidollars. So, being the quick study that I am (note the 30 years) I decided I should take that advice I was given many years ago and actually tell you how I work! Here goes.....the top 10......
1. I can objectively evaluate your home and list it for sale and guide you to a successful closing.
2. I can objectively evaluate and list the homes of your family, friends and enemies if you so kindly refer them to me.
3. I can refer any friends, family or enemies to a qualified real estate agent in other areas. (Just in case you want them close or far away!)
4. I can measure, market, stage, photograph and video the home to make sure every nook and cranny is shown to it's utmost potential. (and not show those not too great bloopers)
5. I can help you find your new home. I can drive endlessly searching for the perfect home and when I get lost use that time to show you the neighborhood, That includes building a new home too! No matter where!
6. I can provide market research to assist you in making a wise buying decision and walk you thru all steps of the process thru closing.
7. I can be depended upon to assist you after closing (no running away on my part!)
8. I can research facts and figures on values if you ever are just curious about the worth of your property or some other property.
9. I can recommend home improvements that will enhance your property or add value.
10. I can recommend home repair and cost saving services.
11. I can arrange for Santa to visit your house before Christmas. (only if you have been good) This is a bonus service!

The list is endless and only limited by not asking me questions.

So, the moral of this story is that perhaps now Steve Savmidollars will know to call me for any and all real estate needs. And if you are ill, bored, stuck at home or the office and you happen to read this in its entirety, you'll know what I do. Since I don't send out recipes, you will also know that I don't cook, but I do help anyone who breaths with real estate needs. (catchy phrase, huh).

E Waste Drive

August 27^th, St Luke’s United Methodist Church will host a community electronic waste recycling event. You can bring anything with a cord to be safely recycled by WorkForce, Inc. In case you were not aware, as of January 1, 2011 electronics can no longer be left at the curb as garbage. They must be recycled! Tell your friends and neighbors. This event is sponsored by St. Luke’s Green Ministry. St. Luke's is located at 100 W. 86th Street.

Second starts needs help! As many of you know, I volunteer weekly for the not-for-profit charity called Second Starts. Its mission is to furnish household goods to the homeless to help them start again. We are in great need of mainly dinner plates (but will take plates of any size) and also drinking glasses. If you are cleaning your cupboards and would like to donate, please give me a call and I’ll be happy to make the pickup. Also happy to take any other items you might be happy without! IT'S THAT TIME OF YEAR AGAIN!

Did you know that the first real “fast food” was introduced at the St. Louis World’s Fair in 1904-----hot dogs and ice cream cones that could be eaten as fairgoers walked around. My…..how we have progressed! Now we have healthy (?) trans-fat free food. There is no end to what can be “battered and deep fried”. The treats you have in store for you this year at the 2011 Indiana State Fair, along with the list of cookies, candy bars and elephant ears, are: deep fried Kool-Aid, ice cream burger, French toast hamburger and deep fried Klondike bars. Somehow Cap’n Crunch gets included in all those delectable dishes! Take a look at the following which MIGHT make you think twice before indulging:

*For a few days leading up to the fair, eat healthy (lower amounts of high fat foods and sugary foods). Eat lots of fruits and vegetables.

*Stay well hydrated.

*Exercise at least as much, or more, than you normally do. Remember 1 pound = 3,500 calories.

*Share your favorite foods with family member or friend. Remember, sharing your food=sharing your calories.

*Don’t drink that large (32 oz.) soda. Drink water. A large soda contains approximately 400 calories and the equivalent of 25 teaspoons of sugar.

A DAY OF SEARCHING AND A LESSON LEARNED

You'll notice that this is not my usual light hearted, information packed blog. I spent Sunday joining in the search in the Bloomington area for the missing student Lauren Spierer. Two of my very dear friends joined me and we teamed up with 4 others. One girl with us came as far away as Florida. Several of these people had searched on previous days. We only had 1 1/2 miles of road to search, which doesn't seem like much, but it encompassed so much more than just the road. We walked rugged terrain looking in tall grass, wooded areas, abandoned buildings, culverts. No area was considered to be insignificant. It's mind boggling when you think about the vast areas that have already been searched or need to be searched. It was overwhelming and amazing to see the organization and dedication of those involved in keeping this effort alive. I can't begin to imagine how hard this is for her parents. It's a sobering experience. It made me stop and think how truly blessed I have been and that my troubles are insignifcant compared to what this family has had to endure.

DON'T TAKE PERSONAL SAFETY LIGHTLY!!!!! We all probably think we are invincible. I know I do. Take the time to read articles on personal safety. There are a gazillion on the Internet! Two of the best are: PAY ATTENTION TO YOUR INSTINCTS! AND SCREAM! You always have these two items with you. Use them!!!!!

Are you ready for a cool phenomenon??? This year and this year only, we are going to experience four unusual dates. 1/1/11, 1/11/11, 11/1/11, and 11/11/11. But......that's not all. Take the last 2 digits of your year of birth (no lying here), add the age you will be this year (must be truthful) and the result will be 111 for everyone! I know it's not "magic", but it sounds like it. Also, October will have 5 Sundays, 5 Mondays and 5 Saturdays. This happens only every 823 years. (For those of you who like stats). And the best part, this is the year of MONEY! These particular years are known as "Moneybags". I think it's supposed to be 'lucky' if you send this info to your friends and you will be showered with money (Maybe it will replace all this rain!) Anyway, worth a try. Well, this certainly is a day to wonder "when will winter end"? I think today in Indiana it's pretty certain Phil would not see his shadow. But that pesky devil doesn't live here. However, Phil came out of hiding in Punxsutawney, Pennsylvania and did not see his shadow -- that means we are in for an early Spring, if you believe the furry prognosticator. (which, in fact, I do). So, sharpen up those weeding and gardening tools and lube those wheels and get ready.

LIGHTS, MOON, EXEMPTIONS!!!

Ever wondered how to make sure the lights are placed right on a tree? Just step back about 10 feet and squint and all the "holes" appear. Also, start stringing the lights from the bottom up to make sure you can make the electrical connection!!!!!

Get ready for the longest day of the year and a special surprise. December 21st will be the Winter Solstice and we will also experience a total lunar eclipse sometime after midnight. Though the winter solstice lasts only an instant in time, the term is also colloquially used as midwinter or contrastingly the first day of winter to refer to the day on which it occurs.

The Marion County Auditor's office is researching Marion County properties for homestead exemptions that are not owner occupied. If you own RENTAL PROPERTY which is being given a HOMESTEAD EXEMPTION please be aware of the following. You should correct them immediately to avoid being charged a penalty and possible back taxes. People found guilty of homestead fraud will charged up to THREE YEARS back, plus penalty.

As you may or may not know, I volunteer each week to help SECOND STARTS, an organization established in 2002, that addresses the household start-up needs of families in housing crisis in the Indianapolis, Indiana, area. This is accomplished by accepting donations of new and gently used household items. I have included a list of items recommended for donations. Presently we are in great need for towels and sheets.

So, if you are thinking Goodwill, think of SECOND STARTS. This is the perfect time to clean out the old, or just simplify your life. PINK SLIPS AREN'T ALL BAD!!!

In case you missed it, those of you in Marion County, there was a PINK SLIP enclosed with your notification of your new assessment. The assessors are trying to verify Homestead Exemptions. You don't want to miss out on that!!!! Go to this site to learn more: PINK SLIP If you live in a county adjacent to Marion County, you, too, will want to verifiy that the exemption has been filed. It could save you THOUSANDS. Call your local county assessor to check it out.

THE SECRET TO MY GREEN THUMB!!!! I know you all have your cell phone stories on why you "didn't get your call". I think this one might top them all. I purchased a new butterfly bush from Habig's Garden Center (always try to buy local). I rushed home and planted it in the perfect spot eager for the butterflies to start discovering it. (Okay, it's also so my cats will have something to chase). Three hours later and after 50 phone calls from my son, I discovered my cell phone had been "planted" six inches under the dirt! Maybe that butterfly bush will be able to "call" the butterflies to come to dinner!

My newest favorite book "Grandpa's 5001 Handyman Secrets and its AS SEEN ON TV! Here's a good one: To loosen a joint (on wood) apply vinegar. Just fill a small oilcan (we all still have those around!) with white vinegar and apply it liberlly to the joints. Wish that would work on my bone joints! Stay tuned for more next month!

ARE YOU READY FOR THIS?????? A search engine that has been created for the 50+ crowd. It's called Good50.com, but it really has good features for all the family. Check out the information from the Good50 website below.

Good50 is Health-Friendly. Designed with the public's health in mind, Good50 has pre-set the search box to a larger size and gives the option to adjust to a larger font in the search results. These features of Good50 will reduce eye strain and help to prevent Computer Vision Syndrome (CVS). Some possible symptoms of CVS include headaches, dry and/or red eyes, fatigue, double vision, and neck or back pain.

Large Search Box. When typing in a search term, you can strain your eyes trying to distinguish between similar looking letters and symbols, but with a larger search box, it's no problem. Here's an example:
On-screen Zoom. Good50's on-screen zoom feature lets you enlarge the view of your search result for enhanced readability. This feature is particularly useful for older adults and senior citizens, or people with low vision. Currently, our on-screen zoom feature for the search result works well with Internet Explorer only. Users of Firefox and Chrome are advised to use the keyboard short cut, Ctrl+ and Ctrl- to zoom in and zoom out.

Good50 has Fewer Ads. Many search engines have text-link ads (Sponsors) at the top of the results, which is where the most relevant results are to be displayed. WOMEN AND HEART ATTACKS! Did you know that women rarely have the same dramatic symptoms that men have when experiencing a heart attack? You know, the sudden stabbing pain in the chest, the cold sweat, grabbing the chest and dropping to the floor that we see in the movies. Be aware of the following:

WHAT'S MY CREDIT SCORE AND WHAT DOES IT MEAN???????

Want to know how to improve and keep up your credit score? The following article published by The Associated Press should help.

Your past is never really behind you. Or so it seems when it comes to credit reports.

As you prepare to shape up your finances in 2010, you'll find that improving your credit score is among the more complicated tasks. You may be bewildered by what helps or hurts your score, by how much and for how long. Regardless of whether you understand how it's calculated, the number you're tagged with can play a big hand in your financial fate.

Banks use credit scores to help decide whether to extend loans, and if so, at what price. A lower score will likely mean higher interest rates on credit cards, student loans and mortgages. In the latter scenario, the difference could amount to hundreds of dollars a month.

Generally speaking, a score below 620 is considered poor; 620-659 is fair; 660-749 is good, and 750-850 is excellent. It currently only costs $15.95 to get your score at MyFico.com.

Here are some actions you can take, now and over time, to raise your number.

WHAT TO DO NOW. One of the fastest ways to improve your score is to pay down your balances. How much of a lift you'll get will depend on your overall credit profile. But, paying off all balances could push someone in the 650-range into the 700-range. This is because the portion of your credit line that you're using---your so-called credit utilization----is a big component of your score, accounting for about 30%.

If you buy the standard FICO score package at MyFico.com, you can access a simulator that tells just how much certain actions will lift or lower your score. For some scenarios, you can see how your score would change over one month, versus six months or two years.

In the case of paying down your balances, note that it provides a one-time benefit. You don't get any extra points for keeping your credit usage at a low level.

Also, keep in mind that your report could reflect a high utilization even if you pay your bills on time. This could happen if your lender reports your balance to the credit bureau before you pay your bill. To avoid this scenario, pay off charges as soon as you can---don't wait for due dates.

Another way to have a short-term impact on your score is to make payments on time. If you've been chronically late in the past several months, paying all your bills on time for just one month could boost your score by as much as 20 points.

You'll also want to check for any mistakes on your credit report, since your score is calculated based on the information it contains. You're entitled to ONE FREE CREDIT REPORT A YEAR from each of the credit bureaus---Equifax, Experian and TransUnion. To get your free reports, go to http://www.annualcreditreport.com/ (beware of sites with similar names).

To correct any information, contact the credit bureau and the lender that reported the error. The Federal Trade Commission provides a sample letter on http://www.ftc.gov/ (click on "Credit & Loans" under the "Quick Finder" tab, then "Credit Reports & Scoring" and scroll to the bottom).

DIGGING IN FOR THE LONG HAUL. Once you pay down your debt, improving your score becomes a game of long-term vigilance. "One week's good behavior isn't indicative of future risk", says Craig Watts, a spokeman for FICO. "To improve a poor score is a long-term project".

The key is keeping your report free of any negative marks, which can take years to recover from. For someone with a score of 680, for example, a foreclosure can zap away as much as 105 points, while a bankruptcy can shave off 150 points. A single late payment of 30 days or more can drop your score by 80 points.

The negative marks, including late payments, appear on your credit report for seven years. Chapter 7 bankruptcies, which wipe clean unsecured debt such as credit card bills, remain for 10 years. And the repercussions recede only over time, assuming you stay current on all your payments.

Applications for new credit ding your score too, although to a lesser degree---usually around five points. Those can add up if you are applying for several different credit accounts while shopping to get discounts.

Finally, think twice before closing any accounts. The length of your credit history counts for about 15% of your score, so it's a good idea to hold onto any cards you've had for a long time. Those older cards, coupled with a steady history of prompt payments, should provide a good path to an improved score.

REUSE THOSE OLD CDs!!!! Just some fun ideas. Try securing them to your bicycle wheels and use them as reflectors!

Forget those ugly orange reflectors. Instead, drill small holes in a CD and screw it onto your mailbox post or onto a wood stake and push it into the ground. Install several of them to create a reflected nighttime path to your front door!

GET READY TO PARTY!!!

For the first time in almost twenty years, there's going to be a Blue Moon on New Year's Eve.

Don't expect the Moon to actually turn blue, though. The "Blue Moon" is a creature of folklore. It is actually the second full Moon in a calendar month.

Most months have only one full Moon. The 29.5-day cadence of the lunar cycle matches up almost perfectly with the 28 to 31-day length of calendar months. The word "month" comes from "Moon". Occasionally, the one-to-one correspondence breaks down when two full Moons squeeze into a single month. December 2009 is such a month. The first full Moon appeared on December 2nd; the second, a "Blue Moon", will come on the eve of the new year, December 31st.

This definition of Blue Moon is relatively new. Many years ago if you told a person that something happens "once in a Blue Moon" they would attach no astronomical meaning to the statement. Blue moon simply meant rare or absurd, like making a date for the Twelfth of Never. But the phrase "Blue Moon" has been around for over 400 years and during that time its meaning has shifted.

The modern astronomical Blue Moon occurs in the some month every 2.5 years, on average. A Blue Moon falling precisely on December 31st, however, is much more unusual. The last time it happened was in 1990, and the next time won't be until 2028.

So, if you are planning something special that will only happen "once in a Blue Moon" this December 31st should be it!!!

I know many of you are out enjoying this extremely colorific ( made this word up) Fall! You just never know what you'll find or when you'll find it. I discovered this little guy peeking out at me while taking a walk thru Crown Hill Cemetery. If you haven't been there, it's one of Indy's best kept secrets. It's full of history, beauty and many stories. Crown Hill Cemetery was dedicated in 1864 both to provide for the large number of American Civil War soldiers from Indiana who had died in the war as well as to provide for the crowding problems in the small 25 acre cemetery for the growing city of Indianapolis. The first burial took place on June 2, 1864 for a young mother named Lucy Ann Seaton, who died of consumption. Previously a private farm outside the city limits, Crown Hill Cemetery encompasses 555 acres. It sits on the highest geographic point in Indianapolis and is well known for the stunning view of downtown Indianapolis from "The Crown."

Did you know Crown Hill Cemetery is the largest refuge for animals in the city, including an estimated 300+ white-tailed deer? It contains 25 miles of paved roads and numerous species of trees, each of which is marked with a number that corresponds to its scientific name and its common name. Today it is a popular place for hiking, biking, picnics or just take advantage of some of the wonderful guided tours rich in history and area lore complete with tales of the rich and not-so-famous.

Wasp Spray for Pesky Intruders?

If you don't have a gun, here's a more humane way to wreck someone's evil plans for you. Did you know this? I didn't. I never really thought of it before. I guess I can get rid of the baseball bat. A report from a local police department states that a can of wasp spray, instead of pepper spray, is just as effective, if not better, to stop those pesky intruders. The wasp spray can shoot up to twenty feet away and is a lot more accurate, while with the pepper spray, they have to get too close to you and could overpower you. The wasp spray temporarily blinds an attacker until they get to the hospital for an antidote. You can keep a can on your desk in the office or in your car or any room of your house! It doesn't attract attention from people like a can of pepper spray would.

Thought this was interesting and might be of use. It’s inexpensive, easy to find, and more effective than mace or pepper spray. The cans typically shoot 20 to 30 feet; so if someone tries to break into your home, "spray the culprit in the eyes". It’s going to give you a chance to call the police; maybe get out. Maybe even save a life.

’09 Property Tax Bills are Coming!

The Marion County taxes have been certified. Tax bills are scheduled to be mailed out on June 12th with a due date of July 9th. Your tax liability will be available for review on June 12th on the Marion County Treasurer’s website.

Accompanying the newly formatted bill will be a new state-required form which provides a comparison of taxes between the prior and current cycle. If you believe your assessed value is too high, you can appeal the value. Most appeals are filed with the Marion County Assessor, but it is recommended that you talk with your Township Assessor before filing an appeal. The local Township assessor may be able to answer questions that will help you determine whether an appeal is appropriate. You can find contact information to your local assessor under FAQ’s (under property taxes tab) on the above website.

Most tax bills will be mailed to your mortgage servicer to be paid out of your escrow account. If you are one of the many people affected by a negative escrow balance due to the property tax issue, be sure to contact your mortgage lender and request that your escrow account be analyzed.

Hopefully this will bring us a step closer to figuring out tax escrows at closing real estate transactions. If I can answer any questions for you, please give me a call. We can be confused together!

April (and May) Showers Bring May WEEDS!!!! Finally, my dry creek bed is dry and the weeds have been pulled! Maybe now I can enjoy my gardens. Let me know if you are in the area. I'd love to share a relaxing moment with you! But, that reminds me of several things yet to do. Just some things for you current homeowners, or soon-to-be homeowners to think about to ensure to get the most out of your investment when the time comes (and hopefully you'll think to call me!) Preventive maintenance is crucial to the value of your home. Don't let problems around the house turn in to money drains!

Divert water. Clean gutters and make sure water from downspouts is flowing at least 2 to 2 1/2 feet from the foundation.

Retain the roof. After the next rain check for wet spots on the ceiling or check rafters in attic for water stains.

Check your paint job. The worst thing is to leave wood exposed. This will lead to wood rot and a whole host of problems.

Cut shrubs and trees. Keep them away from the house to prevent moisture and mildew. Get rid of out of control vines. They can crack siding and mortar allowing moisture to penetrate.

Windows and doors. May sure all windows and doors have a good seal and check for leaks and drafts. Look for chipping or peeling paint which could indicate a moisture problem.

Check the plumbing. Except for the coffee maker, nothing should be dripping in or around the home!

A tax credit of up to $8,000 is now available for qualified first-time home buyers purchasing a principal residence on or after January 1, 2009 and before December 1, 2009. Unlike the tax credit enacted in 2008, the new credit does not have to be repaid.

The American Recovery and Reinvestment Act of 2009 authorizes a tax credit of up to $8,000 for qualified first-time home buyers purchasing a principal residence on or after January 1, 2009 and before December 1, 2009.

The following questions and answers provide basic information about the tax credit. If you have more specific questions, we strongly encourage you to consult a qualified tax advisor or legal professional about your unique situation.

Who is eligible to claim the tax credit?
First-time home buyers purchasing any kind of home—new or resale—are eligible for the tax credit. To qualify for the tax credit, a home purchase must occur on or after January 1, 2009 and before December 1, 2009. For the purposes of the tax credit, the purchase date is the date when closing occurs and the title to the property transfers to the home owner.

1. Who is eligible to claim the tax credit? First-time home buyers purchasing any kind of home—new or resale—are eligible for the tax credit. To qualify for the tax credit, a home purchase must occur on or after January 1, 2009 and before December 1, 2009. For the purposes of the tax credit, the purchase date is the date when closing occurs and the title to the property transfers to the home owner.

2. What is the definition of a first-time home buyer? The law defines "first-time home buyer" as a buyer who has not owned a principal residence during the three-year period prior to the purchase. For married taxpayers, the law tests the homeownership history of both the home buyer and his/her spouse.

For example, if you have not owned a home in the past three years but your spouse has owned a principal residence, neither you nor your spouse qualifies for the first-time home buyer tax credit. However, unmarried joint purchasers may allocate the credit amount to any buyer who qualifies as a first-time buyer, such as may occur if a parent jointly purchases a home with a son or daughter. Ownership of a vacation home or rental property not used as a principal residence does not disqualify a buyer as a first-time home buyer.

3. How is the amount of the tax credit determined?
The tax credit is equal to 10 percent of the home’s purchase price up to a maximum of $8,000.

4. Are there any income limits for claiming the tax credit?
The tax credit amount is reduced for buyers with a modified adjusted gross income (MAGI) of more than $75,000 for single taxpayers and $150,000 for married taxpayers filing a joint return. The tax credit amount is reduced to zero for taxpayers with MAGI of more than $95,000 (single) or $170,000 (married) and is reduced proportionally for taxpayers with MAGIs between these amounts.

5. What is "modified adjusted gross income"?
Modified adjusted gross income or MAGI is defined by the IRS. To find it, a taxpayer must first determine "adjusted gross income" or AGI. AGI is total income for a year minus certain deductions (known as "adjustments" or "above-the-line deductions"), but before itemized deductions from Schedule A or personal exemptions are subtracted. On Forms 1040 and 1040A, AGI is the last number on page 1 and first number on page 2 of the form. For Form 1040-EZ, AGI appears on line 4 (as of 2007). Note that AGI includes all forms of income including wages, salaries, interest income, dividends and capital gains.

To determine modified adjusted gross income (MAGI), add to AGI certain amounts such as foreign income, foreign-housing deductions, student-loan deductions, IRA-contribution deductions and deductions for higher-education costs.

6. If my modified adjusted gross income (MAGI) is above the limit, do I qualify for any tax credit?
Possibly. It depends on your income. Partial credits of less than $8,000 are available for some taxpayers whose MAGI exceeds the phaseout limits.

7. Can you give me an example of how the partial tax credit is determined?
Just as an example, assume that a married couple has a modified adjusted gross income of $160,000. The applicable phaseout to qualify for the tax credit is $150,000, and the couple is $10,000 over this amount. Dividing $10,000 by $20,000 yields 0.5. When you subtract 0.5 from 1.0, the result is 0.5. To determine the amount of the partial first-time home buyer tax credit that is available to this couple, multiply $8,000 by 0.5. The result is $4,000.

Here’s another example: assume that an individual home buyer has a modified adjusted gross income of $88,000. The buyer’s income exceeds $75,000 by $13,000. Dividing $13,000 by $20,000 yields 0.65. When you subtract 0.65 from 1.0, the result is 0.35. Multiplying $8,000 by 0.35 shows that the buyer is eligible for a partial tax credit of $2,800.

Please remember that these examples are intended to provide a general idea of how the tax credit might be applied in different circumstances. You should always consult your tax advisor for information relating to your specific circumstances.

8. How is this home buyer tax credit different from the tax credit that Congress enacted in July of 2008?
The most significant difference is that this tax credit does not have to be repaid. Because it had to be repaid, the previous "credit" was essentially an interest-free loan. This tax incentive is a true tax credit. However, home buyers must use the residence as a principal residence for at least three years or face recapture of the tax credit amount. Certain exceptions apply.

9. How do I claim the tax credit? Do I need to complete a form or application?
Participating in the tax credit program is easy. You claim the tax credit on your federal income tax return. Specifically, home buyers should complete IRS Form 5405 to determine their tax credit amount, and then claim this amount on Line 69 of their 1040 income tax return. No other applications or forms are required, and no pre-approval is necessary. However, you will want to be sure that you qualify for the credit under the income limits and first-time home buyer tests.

10. What types of homes will qualify for the tax credit?
Any home that will be used as a principal residence will qualify for the credit. This includes single-family detached homes, attached homes like townhouses and condominiums, manufactured homes (also known as mobile homes) and houseboats. The definition of principal residence is identical to the one used to determine whether you may qualify for the $250,000 / $500,000 capital gain tax exclusion for principal residences.

11. I read that the tax credit is "refundable." What does that mean?
The fact that the credit is refundable means that the home buyer credit can be claimed even if the taxpayer has little or no federal income tax liability to offset. Typically this involves the government sending the taxpayer a check for a portion or even all of the amount of the refundable tax credit.

For example, if a qualified home buyer expected, notwithstanding the tax credit, federal income tax liability of $5,000 and had tax withholding of $4,000 for the year, then without the tax credit the taxpayer would owe the IRS $1,000 on April 15th. Suppose now that the taxpayer qualified for the $8,000 home buyer tax credit. As a result, the taxpayer would receive a check for $7,000 ($8,000 minus the $1,000 owed).

12. I purchased a home in early 2009 and have already filed to receive the $7,500 tax credit on my 2008 tax returns. How can I claim the new $8,000 tax credit instead?
Home buyers in this situation may file an amended 2008 tax return with a 1040X form. You should consult with a tax advisor to ensure you file this return properly.

13. Instead of buying a new home from a home builder, I hired a contractor to construct a home on a lot that I already own. Do I still qualify for the tax credit?
Yes. For the purposes of the home buyer tax credit, a principal residence that is constructed by the home owner is treated by the tax code as having been "purchased" on the date the owner first occupies the house. In this situation, the date of first occupancy must be on or after January 1, 2009 and before December 1, 2009.

In contrast, for newly-constructed homes bought from a home builder, eligibility for the tax credit is determined by the settlement date.

14. Can I claim the tax credit if I finance the purchase of my home under a mortgage revenue bond (MRB) program?
Yes. The tax credit can be combined with the MRB home buyer program. Note that first-time home buyers who purchased a home in 2008 may not claim the tax credit if they are participating in an MRB program.

15. I live in the District of Columbia. Can I claim both the Washington, D.C. first-time home buyer credit and this new credit?
No. You can claim only one.

16. I am not a U.S. citizen. Can I claim the tax credit?
Maybe. Anyone who is not a nonresident alien (as defined by the IRS), who has not owned a principal residence in the previous three years and who meets the income limits test may claim the tax credit for a qualified home purchase. The IRS provides a definition of "nonresident alien" in IRS Publication 519.

17. Is a tax credit the same as a tax deduction?
No. A tax credit is a dollar-for-dollar reduction in what the taxpayer owes. That means that a taxpayer who owes $8,000 in income taxes and who receives an $8,000 tax credit would owe nothing to the IRS.

A tax deduction is subtracted from the amount of income that is taxed. Using the same example, assume the taxpayer is in the 15 percent tax bracket and owes $8,000 in income taxes. If the taxpayer receives an $8,000 deduction, the taxpayer’s tax liability would be reduced by $1,200 (15 percent of $8,000), or lowered from $8,000 to $6,800.

18. Is there any way for a home buyer to access the money allocable to the credit sooner than waiting to file their 2009 tax return?
Yes. Prospective home buyers who believe they qualify for the tax credit are permitted to reduce their income tax withholding. Reducing tax withholding (up to the amount of the credit) will enable the buyer to accumulate cash by raising his/her take home pay. This money can then be applied to the downpayment.

Buyers should adjust their withholding amount on their W-4 via their employer or through their quarterly estimated tax payment. IRS Publication 919 contains rules and guidelines for income tax withholding. Prospective home buyers should note that if income tax withholding is reduced and the tax credit qualified purchase does not occur, then the individual would be liable for repayment to the IRS of income tax and possible interest charges and penalties.

Further, rule changes made as part of the economic stimulus legislation allow home buyers to claim the tax credit and participate in a program financed by tax-exempt bonds. A bill that embraces the need for righting the housing market-the first big step toward economic recovery-was introduced Friday in the U.S. House of Representatives.
H.R. 384, The TARP Reform and Accountability Act, was offered by Rep. Barney Frank (D-Mass.), chair of the House Financial Services Committee. The bill would require the Treasury Department to develop a program, outside the Troubled Asset Relief Program, to stimulate demand for home purchases and lower property inventories, by making affordable mortgages available for qualified buyers through interest rate buy downs, a priority of the National Association of Realtors®.
The measure would amend the TARP provisions of the Emergency Economic Stabilization Act of 2008 to make significant steps to reduce foreclosures, strengthen accountability and close loopholes. Treasury could consider the impact of areas with the highest inventories of foreclosed properties.
NAR President Charles McMillan was heartened by the legislation that would move the housing market forward. “The bill proposed by Chairman Frank is an important first step toward launching a real estate recovery. Housing has always led this country out of economic downturns, and this bill recognizes that the key to bolstering the overall economy is creating stability in the real estate markets. With foreclosure relief, improving the Hope for Homeowners Plan, and expanding TARP to support commercial real estate loans and commercial mortgage-backed securities, this legislation will help create housing stability.”
“By directing the Treasury Department to increase the availability of affordable mortgages rates for qualified home buyers and to offer reduced rate loans designed to stimulate demand for home purchases and clear inventory of properties, Chairman Frank has responded to the most critical issues facing potential homeowners,” McMillan said.
Foreclosure relief, using the second half of the $700 billion previously authorized by Congress, would be conditioned on stipulation that $50 billion be used for foreclosure mitigation and calls for a plan to be put into action by March 15. That would allow the Treasury to begin committing the remaining TARP funds for the plan no later than April 1.
The plan would require that foreclosure assistance must apply only to owner-occupied residences. Further, the bill would provide liability protection for loan servicers who engage in loan modifications. Such servicers would have to report regularly to the Treasury.
In addition, the Treasury would be authorized to provide support for commercial real estate loans and commercial mortgage-backed securities, an NAR priority.
NAR has been urging the incoming Obama administration, as well as Congress, to address critical housing needs. “This legislation is a great beginning, but more needs to be done. We must continue to bring potential homebuyers into the market by ensuring low mortgage interest rates, making the higher 2008 conforming loan limits permanent, and applying the $7,500 tax credit to all home buyers and making it non-repayable,” McMillan said.
